  1. The “CASCADES TIPS FOR A GREENER PLANET CONTEST” (hereafter the “Contest”) is held by and for the benefit of the Cascades Tissue Group,a division of Cascades Canada Inc. (hereafter the “Contest Organizers”) in Canada and on the Internet and takes place from April 19th, 2010 until May 14th, 2010 at 11:59 p.m. ET (hereafter the “Contest Period”).
  2. ELIGIBILITY

  3. The Contest is open to all residents of Canada who have reached the age of majority in their place of residence (according to the laws of their applicable province or territory). The following persons are excluded from participation: employees, agents and representatives of the Contest Organizers, of their parent, associated and affiliated companies, their advertising and promotion agencies, suppliers of prizes, materials or services related to the Contest, as well as members of their immediate families (siblings, children, mother, father), their legal or de facto spouse and all persons with whom these employees, representatives and agents are domiciled.
  4. HOW TO ENTER

    No purchase required.

  5. During the Contest Period, visit the simplegreenaction.ca website, select the “CASCADES TIPS FOR A GREENER PLANET CONTEST” icon and click “Enter”. Create your account to become a member of the simplegreenaction.ca community by filling in all mandatory fields on the registration form, i.e. your first and last name, telephone number (including area code) and email address, choose a password, then confirm your password. Once you have created your account, fill out the entry form by indicating your province and submit your environmental tip (hereafter the “tip”). Certify that you have read and that you accept the Contest Participation Rules, including the Declaration of consent, authorization and release regarding the submitted environmental tip by checking the box to that effect. Then click on “Enter” no later than May 14th, 2010 at 11:59 p.m. ET. A window will appear confirming your entry. You will then obtain one (1) Contest entry.

    If you have already created an account, click on “Already registered?”. Enter your email address and password, and then fill out the entry form as indicated in the previous paragraph.

  6. The following conditions apply to the submitted tip:
    1. The tip must demonstrate a simple way of protecting the environment.
    2. The text must contain a maximum of 140 characters.
    3. The content must be in English or French. The tip must not infringe upon the privacy of any person nor contain the name of any person.
    4. The tip must not have inappropriate content, including explicitly sexual, offensive, harassing, discriminatory, defamatory, violent, malicious or hateful content, nor content that otherwise could affect the good character or general morality of Canadian society or denigrate Cascades Tissue Group’s products or services or those of any of its affiliated companies. The tip must not have suggestive language or encourage any illegal activity; it must not include any commercial content that promotes a product or service other than those of the Contest Organizers. Any part of the tip submitted that consists of content protected by copyright, any other intellectual property rights or third party rights cannot be submitted unless the participant has obtained all necessary rights and authorizations required to that end.
    5. The tip must be created specifically for the Contest and must not have been previously published or submitted in another contest or within the context of another promotion.
  7. To be eligible for the Contest and for their tip to be broadcast, all participants shall provide the following authorizations by checking the appropriate box to that effect appearing on the registration form:

    I give Cascades Tissue Group and its representatives permission to reproduce, disseminate, publish, distribute, perform in public, edit, modify and translate the tip submitted. This authorization is given for worldwide use without compensation and for an unlimited period, for the purposes of the Contest or any other purpose related to the activities of Cascades Tissue Group, including without limitation for broadcast in various media including the simplegreenaction.ca website, web banners, existing Internet platforms (Facebook, Twitter, Flickr, YouTube, etc.) or advertising material promoting the current Contest or future editions thereof, if any, or services or products of Cascades Tissue Group. I agree that my first name, last name and place of residence may be used in association with the submitted tip. I declare that the submitted tip is original, that I am the sole author of the tip or that I have received all necessary authorizations and rights to its use under the terms provided herein, and that I am not violating any law or third party rights. Upon request, I undertake to provide Cascades Tissue Group and its representatives with proof of the authorizations mentioned above. I acknowledge that Cascades Tissue Group and its representatives assume no liability for the use and broadcast of the tip that I submitted for authorized purposes and that they cannot be held liable for any violation of these conditions or terms of use of the website by users. I undertake to reimburse Cascades Tissue Group and its representatives the amount corresponding to any expenditure incurred by them due to any claim or proceedings arising from the use or broadcast of the tip that I submitted.

  8. In any case, the Contest Organizers have the full discretion to broadcast or refuse to broadcast the submitted tip on the Contest website or to withdraw it after it is broadcast, in whole or in part. No notice or explanation will be given to the participants regarding the broadcast or non-broadcast of their submitted tip. If any part of the submitted tip does not abide by these Rules, the Contest Organizers have the full discretion to remove it, modify it in whole or in part or simply disqualify the participant’s Contest entry.
  9. Participation limit

  10. All participants must respect the following limits. Failure to do so will lead to disqualification.
    1. There is a limit of one (1) Contest entry per account, at all times during the Contest Period.
    2. There is a limit of one (1) account per email address, at all times during the Contest Period.
    3. Participants will have to use only one (1) and same email address for the entire Contest Period, even if they have more than one address. To enter the Contest, cookies must not be deactivated.
  11. PRIZE

  12. To be won: 1 year of Cascades Enviro® bathroom tissue and paper towel products, consisting of 40 12-double-roll packages of Cascades Enviro® bathroom tissue and 12 6-roll packages of Cascades Enviro® paper towels, an approximate total retail value of $320. The prize will be awarded in the form of products, as mentioned above, or in the form of gift certificates redeemable for free Cascades Enviro® bathroom tissue products and Cascades Enviro® paper towel products, at the sole discretion of Contest Organizers.
  13. The following conditions apply to the prize:
    1. When choosing the form in which to award the prize, Contest Organizers will take into consideration the winner’s place of residence. However, the final decision as to choosing the form in which to award the prize is entirely at the sole discretion of the Contest Organizers.
  14. The following conditions apply to the prize in the event that it is awarded in the form of gift certificates:
    1. Gifts certificates will be valid for the period of time indicated by the Contest Organizers.
    2. No credit or refund will be given if gift certificates are not used within the prescribed period or if the value of a purchase made during one visit is inferior to the value of the gift certificates.
    3. Gift certificates are not exchangeable for money, in whole or in part.
    4. Gift certificates cannot be combined with any other offer or promotion.
    5. The number of denominations and the form in which the prize will be awarded (e.g. gift certificates, gift cards, savings coupons or credit, etc.) are at the Contest Organizers’ sole discretion.
    6. Gift certificates are subject to all other applicable restrictions and conditions that may be stated on them or conveyed by Contest Organizers.
  15. DRAW

  16. The random draw will take place on May 20th, 2010 at noon (ET) in Montreal (Quebec) at the offices of the agency in charge of organizing the Contest. One (1) eligible entry will be randomly selected among all of the registered entries received during the Contest Period.
  17. Chances OF WINNING

  18. Chances of winning a prize depend on the total number of entries registered during the Contest Period.
  19. PRIZE CLAIM

  20. In order to be declared a winner, the chosen participant must:
    1. Be reached by telephone or email, at the Contest Organizers’ sole discretion, within fifteen (15) days following the draw. In the event that a chosen participant was reached by email, he/she must reply within fifteen (15) days following receipt of said email and conform to the instructions in the email. Any prize notification email followed by a mention that the message was undeliverable will disqualify the chosen participant, and a new participant will be selected.
    2. Correctly answer the mathematical skill-testing question, without help and within a limited time, which will be asked by phone by the Contest Organizers at a moment agreed to in advance or by email.
    3. Sign the declaration form and disclaimer of responsibility (hereafter the “Declaration Form”) that will be sent to him/her and return it to the Contest Organizers within ten (10) days following its receipt. The Declaration Form will state the form in which the prize will be awarded.
    4. In addition to the permissions already granted pursuant to paragraph 5 of these Rules, assign to the Contest Organizers all copyrights or intellectual property rights regarding the submitted tip; waive, for the benefit of Contest Organizers, any moral rights and, upon request, provide any additional documentation demonstrating that he/she owns all rights in the submitted tip, without any compensation. A clause to this effect will be included in the Declaration Form.
    5. Upon request and in a timely manner, provide a piece of identification with a photograph.
  21. A selected person will be disqualified if he/she fails to respect one of the above-mentioned conditions or any other condition set out in these Rules or if he/she refuses to receive his/her prize. In such an event, the prize may be cancelled or a new draw may take place, at the Contest Organizers’ sole discretion, in order to award the prize in accordance with these Rules until a participant is selected and declared a winner.
  22. In the two (2) to four (4) weeks following receipt of the duly signed Declaration Form, the Contest Organizers will send the prize to the winner by mail.
  23. GENERAL CONDITIONS

  24. All registration forms, entry forms and Declaration Forms are subject to the verification of the Contest Organizers. Any registration forms, entry forms or Declaration Forms that are, as the case may be, incomplete, fraudulent, registered/transmitted/submitted late, that do not contain the correct contact information with which to reach the participant or are otherwise non-conforming, will not be eligible towards winning a prize. Registration forms, entry forms, Declaration Forms and information pertaining to Contest entry must be validated to verify each prize claim. The prize will only be allocated after validation and verification.
  25. The use of automated registration software is forbidden. Entries made from multiple email addresses, under multiple identities or using any other method to enter many times will be deemed inadmissible. Contest Organizers reserve the right to disqualify a person or to void one or many entries of anyone entering or trying to enter the Contest by using any means that go against these Rules or that make it unfair for other participants (e.g. piracy, entries exceeding the permitted limit, etc.). This person could be referred to the authorities.
  26. The prize must be accepted as described in these Rules and cannot be transferred – in whole or in part – to another person, replaced by any other prize or exchanged – in whole or in part – against money, except as provided in the following paragraph.
  27. Should it be impossible, difficult and/or more expensive for the Contest Organizers to award the prize (or a part of the prize) as described in these Rules, the Contest Organizers reserve the right to award a prize (or a part of the prize) of similar nature and equivalent value, or, at their sole discretion, the value of the prize indicated in these Rules, in cash.
  28. The winner releases the Contest Organizers, their parent, associated and affiliated companies, their advertising and promotion agencies, their employees, agents and representatives from all responsibility for any damage that could take place by the acceptance and use of the prize. In order to be declared a winner and prior to obtaining the prize, the winning person agrees to sign a Declaration Form to this effect.
  29. The Contest Organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend the Contest, in whole or in part, in the case of any event or human intervention that may corrupt or affect the administration, security, impartiality or progress of the Contest as provided in these Rules, the whole subject to the approval of the Régie des alcools, des courses et des jeux du Québec, if required.
  30. The Contest Organizers do not guarantee in any way that the Contest Internet site will be accessible or functional without interruption throughout the Contest Period or that it will be free from any errors.
  31. Any attempt made by an entrant or any other person to deliberately damage the Contest website or any related website or undermine or sabotage the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, the Contest Organizers reserve the right to reject the entrant’s participation in the Contest and seek damages from any such person to the fullest extent permitted by law.
  32. In the event that the computer system, for any reason whatsoever, is not able to register all Contest entries during the Contest Period, or if the Contest was to end in whole or in part before the end date stated in these Rules, the Contest Organizers will proceed to a random selection of a person among all admissible entries registered during the Contest Period or at the date of the event that terminated the Contest.
  33. In any case, the Contest Organizers, their parent, associated and affiliated companies, their advertising and promotion agencies, suppliers of prizes, materials or services related to the Contest as well as their employees, agents and representatives will not be obligated to allocate more prizes than what is stipulated in these Rules or to allocate the prize in any other way than that stated in these Rules.
  34. The Contest Organizers, their parent, associated and affiliated companies, their advertising and promotion agencies, their employees, agents and representatives are released from any responsibility related to the malfunction of any data processing component, of all software or of all lines of communication relating to the loss or absence of communication and which may limit or prevent any person from participating in the Contest. The Contest Organizers, their parent, associated and affiliated companies, their advertising and promotion agencies, their employees, agents and representatives are also released from any responsibility for any damage or any loss that may have been caused, directly or indirectly, in whole or in part, by the downloading of any Internet page or any software related to entering the Contest.
  35. By entering or by attempting to enter the Contest, all persons release the Contest Organizers, their parent, associated and affiliated companies, their advertising and promotion agencies, their employees, agents and representatives of all damages that may occur as a result of the participation or attempted participation in the Contest.
  36. By entering the Contest, any winning person authorizes the Contest Organizers and their representatives to use, if needed, his/her name, photo, image, declaration in regards to the prize, place of residence and/or voice for advertising purposes, without any form or compensation. A statement to this effect will be included in the Declaration Form.
  37. Contest Organizers will not be held responsible for any registration forms, entry forms or Declaration Forms sent erroneously, transmitted late or lost. All Declaration forms become the property of Contest Organizers and will in no circumstances be returned to entrants.
  38. For the purpose of these Rules, the participant/entrant is considered to be the person whose contact information has been entered online when his/her account was created on the Contest website. It is this person whom will be asked to answer the mathematical skill-testing question. It is also the person to whom the prize will be awarded if he/she is selected at random and if he/she is declared a winner.
  39. For residents of Quebec, any dispute with respect to organizing or conducting an advertising contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for scrutiny. A dispute with respect to the awarding of a prize may be submitted to the Régie for the sole purpose of intervention in order to achieve resolution.
  40. Any decision on the part of the Contest Organizers or of their representatives, related to the Contest, is final and without appeal, subject to any decision of the Régie des alcools, des courses et des jeux du Québec having to do with matters related to its competence.
  41. No communication or correspondence will be exchanged with participants within the context of the Contest other than what is specified in these Rules or as initiated by the Contest Organizers.
  42. Participants’ personal information collected during the Contest will be used solely for managing the Contest. No commercial communication or other, unrelated to the Contest, will be sent to participants unless they authorize it by failing to uncheck the box to this effect on their entry form.
  43. If a paragraph of these Rules is declared illegal, non-executable or nil by a competent court, that paragraph will be considered nil, but all other paragraphs that are not concerned will be applied within the limits permitted by the law.
  44. In case of divergence between the French and the English version of these Rules, the French version will prevail.
