Legal Notice
1. The “Cascades Green Challenge” Contest is held by and for the benefit of the Cascades Tissue Group, a division of Cascades Canada inc. (hereinafter referred to as the “Contest Organizers”) and will take place from April 22nd, 2009 until September 30th, 2009 at 11:59p.m EST. (hereinafter referred to as the “contest period”).
ELIGIBILITY
2. This contest is open to all individuals residing in Canada who have reached the age of majority in their place of residence (according to the applicable laws of the province or territory) and are Canadian citizens. Are excluded: the employees, agents and representatives of the Cascades Tissue Group, a division of Cascades Canada inc, its parent companies and affiliated companies, its advertising and promotional agencies, its prize, equipment and service suppliers associated with this contest, as well as their immediate family members (brothers, sisters, children, parent) or their legal or de facto spouse and all persons with whom these employees, representatives and agents reside.
PURPOSE OF THE CONTEST
3. The aim of the Contest Organizers is to encourage participants to perform environmental and responsible actions. Participants are therefore asked to perform Green Actions of four different levels. Participants will begin with simple challenges that will become more complex and as they progress, also allowing them to earn more chances to win. For example, a level one challenge (Bamboo beginner) equals five (5) chances to win the grand prize, while a level two challenge (intermediate Lime) is worth ten (10) chances to win the grand prize; a level three challenge (expert Apple) equals twenty (20) chances to win the grand prize and a level four challenge (virtuoso Oaktree) equals one hundred (100) chances to win the grand prize.

4. Via Internet
During the contest period, visit the website www.simplegreenaction.ca before September 30th, 2009 at 11:59p.m EST. Click on the contest tab and then on the “Register now” link in order to access the electronic form (hereinafter referred to as the “form”). Enter all required information: your first name, surname, e-mail address, phone number, your province, username and password. You must confirm the password you have chosen, enter and then validate the two words displayed in the corresponding captcha square, accept the terms and conditions of use of the site and click on “Sign up now”.
5. Once the form has been completed you must choose a challenge. The various challenges are available in your profile under “Challenges to complete”. You must complete at least one challenge and photograph the realization of the challenge as proof. The photo evidence must meet the requirements established prior to each challenge. These requirements can be viewed on the participant’s profile page. You must then submit your photo evidence of the action performed to the Contest Organizers for validation. Once your proof has been validated, you obtain the number of chances to win assigned to the challengechallengeyou have just completed.
HOW TO INCREASE YOUR CHANCES TO WIN:
6. If you sign up between April 22, 2009 and May 22, 2009 (no later than 11:59p.m EST) you will earn five (5) more chances to win. These five (5) additional chances will only be valid if you complete at least one challenge.
7. For each person you invite to join using the tool provided for this purpose, you will earn one (1) more chance to win. This additional chance will only be valid if your guest completes his or her registration and a first challenge.
8. Challenges are available in four (4) different levels of difficulty and as the level of difficulty increases, so do the participant’s chances to win. All participants enter the contest at the first level. A minimum number of chances are then needed to enter the next level.
Below are the details of scores and levels:
All persons registered access the first level (Bamboo beginner) and each challenge equals 5 chances to win. To enter the second level (intermediate Lime) a participant must earn a total of 25 chances. Level two challenges (intermediate Lime) are worth 10 points each. To enter the third level (expert Apple) a participant must have a total of 150 chances. Level three challenges (expert Apple) are worth 20 points each. To enter the fourth level (virtuoso Oaktree) a participant must have a total of 250 chances. Level four challenges (virtuoso Oaktree) are worth 100 points each.
PRIZE
The prizes are:
a) Discount coupons for a value of $0.75, $1 and $1.25.
b) A gift certificate for two (2) people worth approximately $5,000.
9. Discount coupons for a value of $0.75, $1 and $1.25.
These coupons will be offered to participants who enter the next level.
A maximum of 3 coupons will be allocated for the duration of the contest. The value will increase as the next level is reached; $0.75 when a participant moves from Level 1 (Bamboo beginner) to level 2 (intermediate Lime); $1 when a participant moves from level 2 (intermediate Lime) to Level 3 (expert Apple); $1.25 when a participant moves from Level 3 (expert Apple) to Level 4 (virtuoso Oaktree).
The discount coupons will be made available via a hyperlink on the contest’s website.
Participants will receive all coupons won in a single transaction at the end of the contest, or after September 30th, 2009 (11:59p.m ET).
10. A gift certificate for two (2) people worth approximately $5,000.
This gift certificate includes:
-a 7-day Ecotourism trip equivalent to either the cycling or the hiking program offered by Ekilib;

-2 economy class round trip tickets for travel with Air France from Montreal or Toronto;

This gift certificate does not include:
- return travel between the winner’s residence and the airport;
- return transfer from airport to accommodation;
- passport;
- beverages (alcoholic or non-alcoholic);
- international airport duties (major Canadian airports and countries visited);
- gratuities to local guides, cooks and porters if applicable;
- insurance.
11. Terms & Conditions
- All reservations must be made at least three (3) months in advance;
- Winners must book their travel before September 30th, 2010. Travel must be completed before December 31st, 2010. No extensions will be granted;
- The trip is subject to airline and ground service provider availability;
- Once a booking has been made, no changes are allowed. Reservations are non-refundable and are not redeemable in cash; they may not be transferred, in whole or in part;
- Additional costs are borne by the winners and include, but are not limited to: the cost of travel insurance and all other related travel costs which are not described above or exceed the cost of travel;
- Winners must have a valid Canadian passport and a valid visa, if required, and be available for a period of seven (7) consecutive days;
- Anyone accompanying the winner must have reached the age of majority in his or her place of residence and hold a valid Canadian passport;
- At any given time, persons traveling must be able to provide their Canadian passport, a copy of their application form or a personal written statement confirming that they intend to submit a passport application, namely at the time they claim the prize or collect the air travel tickets.
- The approximate retail value of this prize is CA$5,000. The maximum value may not exceed CA$5,000 unless the winner assumes the additional cost;
- Some conditions may apply.
Upon receipt of the declaration and liability release forms (as specified in the appendix) duly signed by the winner and guest, a representative of the Ekilib travel agency will contact the winner to confirm the prize and explain how travel reservations can be made.
DRAW
12. The random draw among all entries recorded will take place between October 1st, 2009 and October 16th, 2009 at noon (EST) in Montreal (Quebec) at the offices of the agency in charge of organizing the contest. The odds of winning depend on the total number of chances accumulated by the participant and the total number of participants who complete at least one challenge and comply with the contest rules.
WINNER SELECTION
13. A pre-selection email will be sent to certain participants drawn randomly among those participants who have met the terms and conditions stipulated herein.
14. In order to be declared winner, the randomly selected participant must respond to a pre-selection email within five (5) days of receipt confirming his or her acceptance of the prize, and confirm that he or she meets the following conditions when the Contest Organizers call:
a) Has reached the age of majority in his or her place of residence and meets the eligibility criteria.
b) Is available 7 consecutive days for travel within the next 12 months;
c) Holds a valid Canadian passport, or is in the process of obtaining one;
d) Has the right to travel to the country of destination
e) Correctly answers the mathematical question asked during the call that follows the pre-selection period: (140 – 20) ÷ 3 + 5 = _____.;
f) Signs the liability waiver declaration (hereinafter referred to as the “Declaration Form”) that will be sent to him or her and returns it to the Contest Organizers within ten (10) days of receipt.
g) In all cases, the Contest Organizers, their affiliated companies, their advertising and promotional agencies, their prize, equipment and service suppliers associated with this contest, as well as their employees, agents, representatives and immediate relatives (parents, brother, sister, children) shall not be required to award any prize other than that stipulated herein.
Conditions a), b), c), d), f), and g) also apply, in whole, to the guest.
15. If the selected person fails to comply with one of the above-mentioned conditions, or any other condition set out herein, or refuses to claim his or her prize, he or she will be disqualified without compensation and a new draw may take place at the discretion of the organizers. The new draw will take place to award the prize in compliance with the present rules until a person is selected and declared winner.
16. In the fifteen (15) days following receipt of the Declaration Form, the Contest Organizers will address an email to the winner with the information needed to take possession of the prize.
17. All entry forms submitted may be verified by the Contest Organizers. Any entries that, as applicable, are incomplete, fraudulent or submitted after the deadline, challengeshall be deemed invalid and will be rejected.
18. The use of automated entry software is prohibited. Entries made from multiple email addresses under multiple identities or using any other device or means to register multiple times will be deemed ineligible. The Contest Organizers reserve the right to disqualify a person or to cancel one or several entry challenge forms from a person who has participated or attempted to participate in this contest in a manner that is in breach of the present rules, or in a manner which is unfair to the other participants (i.e. entries that exceed the maximum number authorized challenge, computer fraud, etc.). Said person may be referred to the appropriate legal authorities. Furthermore, before awarding the prize, the Contest Organizers will perform the necessary verifications. If these verifications show that a participant having received a pre-selection message has not complied with the contest rules, said participant will be disqualified and forfeit the prize.
19. The prize must be accepted as described and as awarded and may not be transferred to another person, exchanged for another prize or exchanged, in whole or in part, for cash, except as provided for in the following paragraph and provided that, at the Contest Organizers’ discretion, the trip may be transferred to another person in the event that the winner is unable to travel outside the country for exceptional or health-related circumstances. Travel arrangements may not be changed once the booking has been made.
20. In the event that, for reasons beyond their control and unrelated to the winner, the Contest Organizers are unable to award the prize as described herein, they reserve the right to award a prize of similar nature and equivalent value or, at their sole discretion, to award a prize of the value that the Cascades Tissue Group, a division of Cascades Canada Inc., or its partners, would have paid for said prize. In such a case, all prize winners waive all recourse or legal proceedings against the Cascades Tissue Group and the contest partners.
21. The winner releases the Contest Organizers, their affiliated companies, their advertising and promotional agencies, their employees, agents and representatives from all liability with regard to any prejudice that may arise from his or her acceptance and use of the prize. In order to be declared winner, and prior to obtaining the prize, the winner agrees to sign a Declaration Form to this effect.
22. If the winner, or the person accompanying the winner, should withdraw from the group before or after the beginning of the trip due to illness, injury or otherwise, there will be no compensation for any unused portion of travel or activities. In addition, if a person is denied access to the country of destination for any reason whatsoever, no compensation will be paid to this effect for the unused portion of travel or activities.
23. The tour organizers (or any suppliers, agencies or employees) may be required to act to in the best interests and safety of the winner and his or her guest. The winner and his or her guest agree to comply with local authorities, respect the decisions and instructions of the tour organizers (suppliers, agencies or employees) and abide by all applicable laws. If in failing to do so, or if in the opinion of the tour organizers (suppliers, agencies or employees), they disrupt the atmosphere of the tour or the general welfare of one or more tour members, or if they notably disrupt the tour’s operation with their behaviour, gestures, words or attitude, the tour organizers reserve the right to deny them access to the tour or deny them the right to comlete the tour. Under such circumstances, the winner shall be responsible for organising his or her return travel and shall bear all associated costs, without compensation.
24. All vehicles providing transportation during the tour, buses and planes in particular, will depart at the exact place and time specified. If the winner, or his or guest, is not present at said place and time, the vehicle will depart without them. If the winner, or his or her guest, should miss said means of transportation (plane in particular) for the previously stated reasons, or for other reasons not caused by the tour organizers, the winner, and his or her guest, acknowledges that he or she shall be responsible for organizing his or her return travel (return travel to the city of departure in particular) and shall bear all associated costs. The contest organizers and other beneficiaries of the liability waiver shall not be held liable for any expenses and prejudice incurred by the winner, or his or her guest, if the vehicle leaves without him or her. The winner and his or her guest must travel together.
25. The Contest Organizers are not required to cater to the needs of handicapped individuals or offer them particular services. The Contest Organizers cannot be held liable in the event their suppliers, agencies or employees are unable to supply particular services such as wheel chair installation. However, if the winner advises the Contest Organizers within a reasonable timeframe prior to the departure date, they will try to accommodate his request.
GENERAL TERMS & CONDITIONS CONCERNING THE COMPLETION OF A CHALLENGE
26. The photo submitted must meet the following eligibility criteria. The photo:
a) must not advocate violence, racism, sexism, pornography or hate;
b) must comply with the requirements stipulated on the page “Challenges to complete”;
c) must positively promote the environment;
d) must be an original photo that is not the property of a third party and is not protected by copyright;
e) must only pertain to the challenge being completed;
f) may only be used once for the purpose of this contest.
27. If the participant does not comply with one or more of the rules mentioned above, he or she will be disqualified from the contest and his or her profile deleted. At all times, the Contest Organizers reserve the right to delete any photo deemed ineligible.
28. Any photos for which a complaint is submitted may be removed from the contest’s website at the sole discretion of the Contest Organizers. Complaints in this regard may be sent to contact@simplegreenaction.ca
29. Once submitted and validated, the photos become the property of the Contest Organizers; the participant therefore waives any copyright or other intellectual property or trademark rights.
30. The participants’ profiles, as well as the contest Web pages, may be verified by the Contest Organizers. All incomplete or fraudulent entries, entries submitted after the deadline or containing incorrect contact information, or entries that are otherwise non-compliant, will not be eligible for a chance to win the prize. Entry forms, registration information, evaluations and videos must be validated in order to verify each prize claim (discount coupons or gift certificate for a value of approximately $5,000, as described herein). Prizes will only be awarded after they have been validated and verified.
31. Each prize must be accepted as described and awarded, and may not be transferred to another person, substituted for another prize or exchanged, in full or in part, for cash, except as provided for below.
GENERAL CONDITIONS
32. The Contest Organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this contest, in whole or in part, in the case of any event, technical service interruption or human intervention that may corrupt or adversely affect the administration, security, impartiality or progress of the contest as provided herein, subject to the approval of Régie des alcools, des courses et des jeux du Québec, if so required.
33. The Contest Organizers by no means guarantee that the contest’s website will be available or operational without interruption for the duration of the contest period or that it will be free of all errors.
34. In the event that the computer system is unable to register all contest entries during the contest period, for any reason whatsoever, or if the contest should be terminated, in whole or in part, before the completion date stated herein, the Contest Organizers will randomly draw a winner among all eligible entries registered during the contest period or at the date on which the contest is terminated.
35. In all cases, the Contest Organizers, their parent companies and related companies and affiliates, their advertising agencies and prize, equipment and services suppliers associated with this contest, as well as their employees, agents and representatives, shall not be required to award more prizes than those stipulated herein or to award prizes other than in accordance with the present contest rules.
36. The Contest Organizers, their affiliated companies, their advertising and promotional agencies, their employees, agents and representatives are released from any liability relating to the malfunction of any data processing component, software or lines of communication resulting in the loss or absence of communication and which may limit or prevent a person from participating in the contest. The Contest Organizers, their advertising and promotional agencies, their employees, agents and representatives are also released from any liability with for any damage or loss that may have been caused, directly or indirectly, in whole or in part, by the download of any Internet page or any software relating to the participation in the contest.
37. By participating, or by attempting to participate, in this contest, the participant releases the Contest Organizers, their advertising and promotional agencies, their affiliated companies, their employees, agents and representatives from all liability with regard to prejudice that may occur as a result of the participation, or attempt to participate, in the present contest.
38. By participating to this contest, the winner authorizes the Contest Organizers and their representatives to use, if required, his name, photograph, image, prize statement, place of residence and/or voice for advertising purposes, without remuneration. A declaration to this effect will be included in the Declaration Form with no limitation as to the period of use.
39. The Contest Organizers remain, at all times, the exclusive owners of the entry forms. The Contest Organizers are not responsible for participation forms that are incorrectly submitted, submitted after the deadline or lost.
40. For the purpose of the present contest rules, the participant is the person whose contact details have been registered online on the contest’s website. It is to this person that the mathematical question will be addressed and to whom the prize will be awarded if his or her entry is drawn and declared winner.
41. For residents of Quebec, any dispute concerning the organization or control of an advertising contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for its ruling. Any dispute concerning the award of a prize may also be submitted to the Régie in which case the Régie shall only intervene in an attempt to resolve the dispute.
42. Any decision on behalf of the Contest Organizers or their representatives relating to the present contest is final and without appeal, and is subject to any decision on behalf of the Régie des alcools, des courses et des jeux du Québec with regard to matters that fall within its scope.
43. If any section of the present rules is declared or judged illegal, non-executable or null by a competent court, the said section shall be considered null and all other paragraphs shall remain in effect within the limits permitted by the law.
44. Subject to the provisions of section 42 of the present rules concerning the scope of intervention of the Régie des alcools, des courses et des jeux, as a prior condition of entry in this contest, each participant agrees that any dispute that can not be settled between the parties, and any cause for action arising from or relating to this contest, must be settled on a case-per-case basis without recourse to any form of class action, exclusively before a competent court located in Montreal, Quebec, and said court must apply the laws of the province of Quebec. The participant and the Contest Organizers waive the right to be judged by a jury.
45. In the event of a discrepancy between the French and English versions of the present rules, the French version shall prevail.
INTELLECTUAL PROPERTY
46. All intellectual property and any promotional materials, Web pages and source codes for this contest and pages of the website hosting the contest are the property of the Contest Organizers and/or its subsidiaries. All rights reserved. Copying or unauthorized use of material protected by copyright or trademarks without the express written consent of the owner is strictly prohibited.
